Title: Texas new abortion law
Post by: Rush on September 02, 2021, 06:17:15 AM
Dare I bring up a delicate subject?  I'd like to analyze this:

Abortion-rights supporters have feared the Supreme Court might rule against access to the procedure after the death of Justice Ruth Bader Ginsburg nearly a year ago. And while Roe v. Wade in 1973 established a constitutional right to have an abortion before the point of fetal viability, the law skirts that precedent by removing enforcement from the state — instead having private citizens be the mechanism to enforce the law through lawsuits.

Here is my issue.  We here have talked a lot about the left wing fascists (Democrats) using private corporations to enforce their censorship (big tech) and persecution of individuals (cancel culture) and vaccine mandates (no jab, no job) in order to get around the Constitution, specifically the 1st and 4th amendments.  It seems that Texas is now doing the same thing, this law is using the private realm to enforce a law rather than direct government enforcement.

On the other hand RvW finding a constitutional "right to have an abortion" is debatable.  I understand the argument that in this case Texas isn't trying to get around an actual constitutional right, but a non-existent one.

On the other other hand, the SC did rule and it is established law until ruled otherwise, which must be, otherwise the system breaks down, despite many people feeling rulings are wrong and indeed often they are overturned when the wrongness becomes too apparent. Then that becomes the law of the land. But until then, this is. Personally I think RvW should be overturned and each state should decide its stand on abortion. But until then, I'm having a problem with how Texas did this, because it looks very much like the tactics the Democrats take: using private entities to do their dirty work for them, getting around the letter of the law in order to violate its intent. That is a dirty filthy commie trick.

I don't want to debate the morality of abortion, but the specifics of how this law is going about enforcing a limitation on it. We talk a lot about the left doing this sort of thing and I don't like the right stooping to that level either.

Despite what the screaming MSM and liberals are saying, the Supreme Court did not approve of the Texas law, nor did they disapprove of it.  The plaintiffs didn't have a good enough case for the Supreme Court to issue an injunction.  The cases are still working their way through the lower courts.

A narrow majority of justices held that the abortion-provider plaintiffs had failed to meet the high standard required for the Supreme Court to issue an injunction blocking a law before it goes into effect.

I agree.  I'm tired of being "holier than thou".  If you want to get down in the mud to beat me, prepare for a mud fight.

I haven’t looked to examine the facts of this law, but already our Wisconsin AG democrat Josh Kaul sent out a pants on fire press release about killing abortion rights or whatever.

As for the USSC, John Roberts’ court has a long history of NOT ruling on the major issues of the day. They are looking at themselves like just another Appeals Court. It’s really pathetic and bad for America.

So the leftist are back to chanting "My Body! My Right!"..............    When it is about abortion.

But bring up the subject of covid.....................

Confirming their Marxist, hypocritical, lying ways purely to advance their agenda.   And they've done it quickly and well using Covid and the MMGW lies.  Now, what are we going to do?  They've rigged the ballot box.  They've stolen the soapbox.   What's left?
