Title: Basic Med Question

I'm eligible for Basic Med or 3rd, 2nd (never tested), etc...


I was in a discussion about BM and someone said there was a limited circumstance that could legally prohibit a pilot operating under BM from being a required crew member where the Pilot Flying was operating with a view limiting device (under the hood). It had some twist regarding who was PIC.


It didn't make any sense to me, but it has been on my mind. I can't find anything approximating the circumstances where a person with a BM cannot do anything someone with a 3rd class cannot, where both are operating under the privileges of a Private Pilot certificate.


I will have to make a decision soon. Due to COVID19, I'm subject to the aeromedical waiver. My AME hasn't been in the office and as soon as the restrictions have been lifted, I'd like to make the decision as to wether or not to renew my 3rd Class or just go BM and be done with it.

Q25: Can I use BasicMed to act as a safety pilot, rather than holding a medical?
A: Only if you’re acting as PIC while performing the duties of safety pilot. The statutory language prescribing BasicMed said it only applies to people acting as PIC. BasicMed cannot be exercised by safety pilots who are not acting as PIC but are required crewmembers.


So, whether is makes sense or not (who really expects the FAA (edit: or any part of government) to be logical?), if you have a basic med, you cannot be a required crew member, but you can act as PIC (in the applicable aircraft).

Clear as mud?

I don’t think that oddity was the fault of the FAA. Congress screwed up the wording in the statute that authorized Basic Med and the FAA had to follow it.

So if the PF is PIC, the Safety Pilot must have 3rd Class or higher? I think that's about what was being discussed.


Any idea when they plan to fix this? I guess this means I'll get a "real" medical.

Due to logistical headaches, it looks like I'll have to get a BasicMed and then later (if needed) upgrade to 3rd Class. What a morass.

I have a Class III, but a friend of mine does Basic Med and is an active IR pilot.  However, I believe he got the Instrument Rating when he had a Class III Medical.  Didn't read the entire thread.  Is it just a TRAINING issue that requires at least a Class III?  Do the regs actually say you must have a Class III or better to do IFR flight?
