It won't make a difference. If Hillary wins Obama will rescind his nomination of Judge Garland and allow Hillary the ability to nominate someone of her choosing, giving the republicans "exactly what they wanted". If Trump wins, it would be pointless for Obama to do a recess appointment because Trump's transition team will immediately begin vetting nominees and make an announcement as soon as he's sworn in. While the SCOTUS will still hear cases early in the year, none of them (that I know of) are 2nd Amendment cases (not that the others aren't important).A recess appointment doesn't expire like that. They expire at the end of the Senate's next session. So a Garland recess appointment could last as long as 2 years, and that would deny Trump a vacancy for that period.
