Who the hell thinks to sue your car insurance company because you chose to have sex in a car? We need tort reform really badly. Loser pay or something, this is out of control. If she wins all of our premiums go up. It will set a precedent for all kinds of ridiculous suits.

The legal stance is that it's our fault. If juries would smack these people down more consistently, lawyers would be more hesitant to sink any time into cases like this.
But I think they're putting too much faith in the populace to be a competent jury. Too often it's "Well that greedy company is rich, let's force them to share some".

Exactly. The person at fault (other than herself) is the guy for not telling her he has HPV. She’d be justified to sue him. But only named the insurance company because that’s where the money was.
The article isn’t totally clear. Maybe she is suing GEICO under the umbrella policy. Maybe it is a general liability and not necessarily an extension of the car policy, in which case it wouldn’t matter where they had sex. However GEICO seemed to indicate that it does. Does this mean his umbrella only was an extension of the auto policy?

You can't get an umbrella insurance claim for hurting yourself. but I think it was the car policy. She was 100% responsible for her choice to have unprotected sex, she will be lucky if HPV is all she got.

I’m not sure protected sex would have saved her. The guy had HPV positive throat cancer. Sounds like she got it from an act not involving the part you put a condom on.
