OK, I have a little opinion on this.

1) MSN is the source?  Sorry, but on an aviation forum you could have found a much better source.

2) "Emergency"? I don't see it.

3) Here's the transmission: http://archive-server.liveatc.net/ksfo/KSFO-Twr-Oct-23-2017-0400Z.mp3, not hard to find. FF to 21:40

4) So far don't see a violation. Not there isn't one in there, but I don't see it yet.

A review of the CVR may say otherwise, assuming it wasn't overwritten. A true NORDO situation with actual lost comms would proceed as last instructed - but the timing is certainly interesting.
