Title: Ghost guns

Quote
Chief Justice John Roberts and Justice Amy Coney Barrett joined the court’s three liberals in temporarily reviving the restrictions. Conservative Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh dissented.

Very disappointed in Amy Coney Barrett.

Ghost guns is yet another made up liberal phrase.   Nothing more than an attempt to stop people from owning or building their own firearm.

Right now several congress idiots are pushing a bill to place a 1000% tax on semi automatic weapons.   The danger here is under the constitution congress can levy taxes, so a SC case would be upheld if challenged.

That is a VERY scary scenario.  Under this bill only the very rich, government, and criminals will have guns.  The rest of us are left out in the cold.  Literally.  Stock up, friends.  Your guns are about to get MUCH more valuable.

It was Roberts who hung ObamaCare around our necks as a "tax".    Using his same logic, the 1000% "tax" would be perfectly legal.

I would hope the SC would see it as a huge infringement but they've shirked their sworn duty before.

It's my understanding that creating monetary barriers to the exercising of constitutionally protected rights would fail.  For example, the poll tax used to make it difficult for the poor to vote (especially certain minorities).  And such an extreme tax would fail for that reason (not because it's a tax)

ObamaCare was an extreme tax to force people to buy an insurance whether they wanted it or not.

Looks like the idea was first brought up in June of last year:

I found this, which indicates similar taxes have been found unconstitutional:

"In some cases, however, the structure of a taxation scheme is such as to suggest that Congress actually intends to regulate under a separate constitutional authority. As long as such separate authority is available to Congress, the imposition of a tax as a penalty for such regulation is valid. In National Federation of Independent Business v. Sebelius (NFIB), the Court reaffirmed that it construes the Constitution to prohibit Congress from using the taxing power to enact taxes that are functionally regulatory penalties as a means of regulating in areas that Congress cannot regulate directly through a separate constitutional authority. The Court has invalidated a few federal taxes on this basis."

  With Roberts who knows?

We'll see if McCarthy even lets the latest bill come to the floor.

And Roberts ADMITTED he went against his sworn duty to enforce the Constitution by saying he didn't want to he the one to strike it down. Well, that's your job dumb ass! He's either blackmailed or bought. Bush installed him for exactly that reason.
