This is the test case that everyone is saying will wind up in the supreme's lap.

The defenders from Hahvahd have just bald-faced lie about racial bias in admissions, and the other side has documented it quite well. We will see what kind of strict construction the new court comes up with.

My two cents worth. I can see both sides of this argument. Minorities will not be well represented in schools like Hahvahd if they just go straight off test scores and grades. But - the big rub comes in where we find out who gets to have their hands on the levers of admission, and why it's all done in secret. If they are going to use race, then say they are going to use race publicly. If they are going to score different races on different standards then publish those standards, stand up and admit it and defend it. Why is Hahvahd trying so hard to keep this under wraps? If they aren't doing anything against the law, then tell us your goals, aspirations, and reasoning for using bias to improve the student body mix, and give the disadvantaged a leg up.

On the other hand, I can see an Asian minority wondering why they work so hard, if they have to compete with others on an uneven playing field. It's quite personal to the student when they are not admitted for something they have absolutely no control over. "I'm sorry Kim-Soo, but you are just too smart, successful, honest, healthy, and giving of your time to attend Hahvahd. We are giving a slot to a Eduardo because he's from Colombia, and he's disadvantaged." It would make me furious.

To some the issue seems convoluted, but it’s really not. Instead of hand wringing about “how to make it fair,” which is impossible, you simply look at all applicants, pick the ones you want, then have a lottery drawing for admissees.  No discrimination, and it removes the stupid ratings and rankings of who is more deserving or underprivileged.

This whole race thing has been actually helped by Fauxcahontus. If everyone is an Indian, no one is an Indian.

And we’re back to being just people again. The left’s tortuous attempts at fairness SHOULD go down in the history books as a sad joke and object lesson.

You can't right past wrongs by punishing the White people, and Asians of TODAY.  That's the progressive fantasy.  All about punishing Whites, and White Males to "get back at them" for the past.  Pure retribution, and hate.  Now the Asians have become caught up in it, so maybe it will get some traction.
