Title: Supreme Court Grants Review on 2nd Amendment Case
Post by: LevelWing on January 24, 2019, 10:40:59 AM
The Supreme Court granted review on a 2nd Amendment case this week. This is the first time since 2009 that it has done so, and many are speculating that this may be a test to see how the Supreme Court reacts which could lead to more 2nd Amendment cases.

From National Review's David French:

Quote from: David French/National Review
Under this law, if you want to transport your gun to a shooting competition outside the city, you can’t. If you’re fortunate enough to own a second home, you can’t even take your own weapon to your own home. You can’t take it to any other shooting range. If you leave your house for an extended period, your gun has to stay in your vacant home. If you’re going to another location — where you have the right to possess or even carry the gun — the weapon can’t travel with you.

This seems like it should be a fairly simple case. The idea that you can't transport a weapon that you own to anywhere other than a designated place by government is ridiculous.

I didn’t read this case, but how does it not violate 18 USC Sec. 926A - Interstate transportation of firearms?

I thought I read something about that but now I can't seem to find it. Most of the articles I've read end up touching on it being the first Supreme Court case, or how the Supreme Court may look to apply a level of scrutiny to the case that they haven't in the past with regards to 2nd Amendment cases.

SCOTUS isn't going to invalidate the NY law on the basis of federal preemption, they're going to do it on the basis of the words "keep" and "bear".  NYC has essentially created a law which states that a person may keep a gun, but may not bear it.  That's a direct contradiction of the 2nd Amendment and I suspect we'll see a 5-4 decision...or maybe a 5-3 decision...overturning the lower courts.
