A little civics background just so we all have the same basic knowledge - National Emergencies are regulated by the National Emergencies Act and by themselves really are nothing more than a proclamation by the president. But what they also allow is for the president to use specific powers which are delegated to him by Congress - there are roughly 140 of these iterated powers possible. Looking at the current emergency, there is a declaration plus invocation of 3 sections of law. The one the Democrats don't seen to understand is section 2808, which authorizes the president to reallocate money to provide for emergency construction to support the deployment of troops. The president's authority is concrete because the Constitution explicitly grants Congress the authority to spend money and they have chosen to delegate a small part of that to the president.
What the Democrats are pointing out now is that is also an emergency power which allows the president to confiscate guns. Of course, that's a bogus law because Congress does not have the authority to do that in the first place, so they cannot delegate authority they don't have. Unfortunately, Leftists have a very low Civics Intelligence score and don't care about laws that get in their way.
