A divided panel of the U.S. Court of Appeals for the Fifth Circuit has affirmed a federal district court’s nationwide injunction against the Obama administration’s Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) program in Texas v. United States. Twenty-six states filed suit against the program on both procedural and substantive grounds. The Fifth Circuit’s decision yesterday increases the likelihood that the lawfulness of DAPA will be resolved by the U.S. Supreme Court, perhaps even as early as next spring (depending on how the administration responds to the ruling).
In an extensive, 70-page ruling, Judge Jerry Smith (joined by Judge Jennifer Elrod) concluded that the states had standing to challenge DAPA and were likely to succeed on both their procedural and substantive claims.

Look for Obama to quickly compel (or "urge" to be kind) the older liberal members of the Supreme Court to retire so that they can be replaced with younger, even more leftist liberal justices, just in time for these cases to come before the Court.
They can't risk Ruth Bader Ginsburg (85) and Steven Breyer (77) getting ill or dying or just retiring after January 20, 2017 where they may be replaced by more conservative jurists.
Obama knows that even though the current Senate has a GOP majority, he has already seen them fold like a cheap suit and give Obama whatever he wants, so the time to strike is right now, before some of these GOP establishment senators who have to run for reelection get some testicles and act tough for their reelection, before going back to their "go-along-to-get-along" ways after the election.
