If Schumer gets what he wants, it seems hard to believe that will be the end of it. The request for more witnesses appears designed to lead not to closure but to reopening the case against Trump. In this way, if Democrats can introduce new testimony in the trial, they can say the new testimony has raised new questions that will require new investigation. And new investigation will require more new witnesses, which will surely lead to more new questions, which ...
Call it the Brett Kavanaugh model of impeachment. During the Supreme Court justice's confirmation process, a hearing had already been held, and Kavanaugh appeared on the way to joining the court. Then, up popped a new allegation, the Christine Blasey Ford story, and Democrats demanded the case be reopened, witnesses be interviewed, evidence be gathered, and time be taken for more investigation. Republicans acceded to those demands, and the Kavanaugh confirmation careened off course for a while before GOP lawmakers finally got it back on track.
It is not beyond imagination that a Senate trial, were it controlled by Schumer and his Democratic colleagues, might take a similarly unforeseen course. Beyond new witnesses, there are plenty of ways that could happen.

An FB friend posed an interesting scenario of Trump were removed from office. Pence becomes President, Pence and Haley face off in a primary battle with Haley becoming the nominee and elected in November, the first women President.
Issue I see is deadlines for primary elections.

There are procedural rules. The Speaker must send the articles to the senate and show the house voted to proceed. The constitution is crystal clear in that the senate has the “sole power” to try the impeachment. It does not mention the house shall approve how the senate carries out its duty.
Pelosi is playing a dangerous and foolish game. McConnell knows it, and how he proceeds we’ll have to wait till Jan 6th.

Pelosi’s procedural standpoint basically gives a speaker-of-the-house veto power over any impeachment vote. The constitution mentions the speaker, but does not mention that power. I presume the speaker has no such veto power over bills whose house votes have passed.

Because the Senate does not just make this stuff up as they go along. 21 years ago, the Senate unanimously agreed to a set of rules to conduct impeachment trials. Those rules start with the appointed House Managers, who will present the articles to the Senate, coming to the Senate and announcing that someone has been impeached (it could be other officials, not just the president).
The process starts with
Whensoever the Senate shall receive notice from the House of Representatives that managers are appointed on their part to conduct an impeachment against any person and are directed to carry articles of impeachment to the Senate, the Secretary of the Senate shall immediately inform the House of Representatives that the Senate is ready to receive the managers for the purpose of exhibiting such articles of impeachment, agreeably to such notice.

Jerrold Nadler, who exactly 21 years earlier, in his opening statement in the Clinton impeachment vote, said, "The effect of impeachment is to overturn the popular will of the voters as expressed in a national election."
There must never be a narrowly voted impeachment or an impeachment substantially supported by one of our major political parties and largely opposed by the other. Such an impeachment would lack legitimacy, would produce divisiveness and bitterness in our politics for years to come. And will call into question the very legitimacy of our political institutions.

Here's what's going on:
Nancy never expected the pushback she's getting on impeachment. Once again, the dims are believing their own bullshit. She and the radicals believed the republicans would join in and push this through, well, because, Orange Man Bad!.
She let a prolific liar run the impeachment inquiry. She let another liar run the second half, and then went forward letting her lawfare people craft laughable reports twisting everything they could to make it look like laws were broken (they weren't).
Every step of the way was buffoonery on display. Now she has her articles in hand, and she knows it's going to fail miserably in the senate, and she will have this hung around her neck as her legacy. She has allowed the radicals to back her into a corner with no way out.
Now her only way out is to try to control the senate and how they handle the trial. She's taking advice from a radical law professor who obviously doesn't understand constitutional law. Even one of the democrats witnesses against the President in the inquiry has told her she is wrong in the way she is handling this, as well as several other noted legal scholars (Turley and Dershowitz).
Knowing the dims and their playbook, look for a January "surprise". Expect Schitt to proclaim they have found "new evidence!" or a new witness and they are going to delay sending the articles while they schedule even more hearings.

When it comes to the senate rules regarding impeachment, just look at Article 1, Section 3 of the constitution:
The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.
Notice it doesn't say "on consent of the House of Representatives"? Nor does it contain any language giving the Speaker of the House and leeway.
The Senate Majority can write whatever rules they desire and pass them on a simple vote.

McConnell told the FOX and Friends hosts that Speaker Pelosi seems to think she can dictate the rules of a Senate impeachment trial.
McConnell also laughed off Chuck Schumer’s ridiculous statements on an impartial senate hearing saying, “Do you think Chuck Schumer is impartial? Do you think Senator Warren is impartial? Do you think Bernie Sanders is impartial? Let’s quit the charade!”

The media was aghast, and Democrats were horrified. "Saying you're going to do just what the president wants is totally out of line," said Minority Leader Chuck Schumer.
Even pseudo-Republican Lisa Murkowski jumped on the outrage bandwagon. "When I heard that, I was disturbed,” she said. “To me, it means that we have to take that step back from being hand in glove with the defense, and so I heard what leader McConnell had said, I happened to think that that has further confused the process."
However, all the outrage is grossly misplaced, as McConnell's statement simply follows the precedent set during Bill Clinton's 1999 impeachment. Fox News noted that in the book The Breach: Inside the Impeachment and Trial of William Jefferson Clinton, published in 2000 and written by Peter Baker, then of the Washington Post, that Senate Democrats coordinated with the Clinton White House during his impeachment trial. Fox News' Adam Shaw explains that "According to Baker, one of those arrangements involved White House Counsel Charles Ruff arranging a 'secret signal' with Democratic leadership. If Ruff wanted to rebut anything from the Republican House managers, something rules didn’t allow for, he pre-arranged with then-Senate Democratic Leader Tom Daschle’s aides for a senator to submit a question to then-Chief Justice William Rehnquist asking the White House to respond." Several Democrat Senators allowed themselves to "be used this way."
According to the book, there was also a coordinated pressure campaign to defeat an attempt by Senator Susan Collins to adopt a "findings of fact" and have the Senate take a majority vote on whether Clinton lied under oath and impeded discovery, regardless of whether the Senate failed to convict him. Baker also described how Democrats decided to ask softball questions to White House lawyers "so they could score rhetorical points.”

As the House and Senate continue their bitter struggle over the coming impeachment trial of President Trump, a judge in the District of Columbia issued an opinion that was largely lost in the crush of New Years stories. The opinion could loom large in the Senate trial, however, and one line in particular, which states "the House clearly has no intention of pursuing" the witness, may be repeated like a mantra by the Trump defense team.
The witness was Charles Kupperman, a deputy to former national security adviser John Bolton. Other than Bolton himself, Kupperman is one of the officials most likely to have direct knowledge of an alleged quid pro quo on aid to Ukraine. After subpoenaing him last fall, the House withdrew its request before the court could rule on compelling his testimony for the record. The House also decided not to subpoena Bolton or any other key witnesses in the administration. Judge Richard Leon dismissed the case before New Years Eve with a hint of frustration, if not bewilderment, that the House did not seem interested in hearing from a possible eyewitness. Historically, that lack of attention in not only witnesses but also a triable case will remain one of the most baffling blunders of this impeachment.
When I testified in the House Judiciary Committee impeachment hearing, I cited this case in my criticism of the pledge by Democrats to impeach Trump by Christmas despite a very incomplete record. While I opposed some of the proposed articles of impeachment that were subsequently dropped by the panel, I said Trump could be legitimately impeached on abuse of power and obstruction of justice if the House could establish such violations. But the House refused to wait just a couple months to build a much stronger case to remove Trump. In the mad rush to push impeachment, Democrats could not have made it easier for his team.
Securing an impeachment so fast does not earn you a historic prize. It simply earns you a historic failure. By not seeking to compel numerous key witnesses, the House now relies on the Senate to complete its case. Since the House has maintained that the record overwhelmingly proves that Trump is guilty, the Senate could simply try the case on the record supplied by the House. Indeed, in the 1999 impeachment of President Clinton, Senate Democrats, including Minority Leader Charles Schumer, fought against any witnesses and sought a summary vote without a trial.
I was particularly concerned about moving forward by Christmas on the second article of alleged obstruction of Congress. The House elected to push through impeachment with an abbreviated period of roughly three months and declared any delay by Trump, even to seek judicial reviews, to be a high crime and misdemeanor. The administration is currently in court challenging demands for witnesses and documents. Just a couple weeks ago, the Supreme Court accepted one such case for review then stayed the lower court decisions ordering the production of the tax and finance records of Trump. The House impeached Trump before that court or other federal courts could rule on the merits of claims of presidential privileges and immunities. Both Bill Clinton and Richard Nixon had been able to take such challenges to the Supreme Court before they faced impeachment.
The House refused to seek to compel several witnesses in court, burning months in which it could have secured not just decisions in its favor but also testimony. Indeed, a year ago, I testified before the House Judiciary Committee and encouraged it not only to hold a vote on impeachment but to go to court to force testimony of figures like former White House counsel Donald McGahn. While refusing to use its impeachment powers with such a vote, it did take him to court. It won that case shortly before its impeachment vote. The case will be heard by the appellate court this week, even without being expedited for the impeachment investigation.
